    EEO-1 report to collect employee pay data

    The Equal Employment Opportunity Commission (EEOC) released its new EEO-1 reporting form this fall, which will require covered employers to provide employee pay data,similar to data reported in Box 1 of Form W-2.

    The form must be provided by private employers, including federal contractors and subcontractors, with 100 or more employees.

    Employers will count their employees during the "workforce snapshot period." For reporting years 2016 and before, the "workforce snapshot period" was July 1 to September 30. Starting with the 2017 EEO-1 report, the "workforce snapshot period" will be October 1 to December 31, 2017. Employers may choose any pay period during this three-month "workforce snapshot period" to count its full and part-time employees for the new report. The new annual filing deadline allows employers to pull W-2 data only once a year for both tax and EE0-1 reporting purposes.

    For summary pay data, employers will report the total number of full and part-time employees during the applicable year in each of 12 pay bands listed for each job category, but do not need to report individual pay or salaries. For aggregate hours worked data, employers must tally and report the number of hours worked that year by all employees accounted for in each pay band.

    Employers affected by this reporting requirement should conduct a review of pay practices prior to the 2018 reporting deadline to proactively identify any areas of EEOC concern.
