Report affects certain employers with 100-plus employees
In late August, the Equal Employment Opportunity Commissions (EEOC) announced (via a memo from the Office of Information and Regulatory Affairs), that the Office of Budget Management (OBM) suspended the pay data collection components of the revised EEO-1 form. Under the Obama administration, the EEOC was seeking W-2 and hours-worked data be included on EEO-1 forms, along with employee data on race, ethnicity and gender.
“OMB has also decided to stay immediately the effectiveness of the revised aspects of the EEO-1 form for good cause, as we believe that continued collection of this information is contrary to the standards of the PRA (Paperwork Reduction Act). Among other things, OMB is concerned that some aspects of the revised collection of information lack practical utility, are unnecessarily burdensome, and do not adequately address privacy and confidentiality issues,” said the memo's author.
The employment data used for the 2017 EEO-1 report should be selected from a payroll period in October, November or December of calendar year 2017. Employer reports must be submitted and certified by March 31, 2018.
As in previous years, employers will receive letters of notification, approximately two months prior to the EEO-1 survey due date.
