    EEOC delays EEO-1 Report until 2021

    The EEO-1 Report is required to be filed with the U.S. Equal Employment Opportunity Commission (EEOC) each year for employers with 100 or more employees. In advance of each annual reporting deadline, the EEOC notifies past filers that the reporting portal is open.

    This year, the March 31, 2020, deadline for submitting 2019 EEO-1 reports passed without any news of when the EEOC would begin accepting the reports. In May, the EEOC released an update announcing that data collection will be delayed for the 2019 EEO-1 reporting period due to the COVID-19 pandemic. The EEOC will begin collecting 2019 data March 2021 and clarifies it “will notify filers of the precise date the surveys will open as soon as it is available.”  When the portal opens next year, employers will be expected to submit EEO-1 reports for both 2019 and 2020.
