Since 2013, employers have been responsible for providing employees one of two Insurance Marketplace notices summarizing their health insurance options. There is no annual obligation to provide the notice to all employees, rather employers must provide the notice to all new hires, regardless of benefit eligibility, within 14 days of their start date. (There is no fine or penalty under the law for failing to provide the notice.)
The Department of Labor (DOL) recently released the model notices with new 2023 expiration dates. There is no notable change in the model notice other than the expiration date. One version of the notice is for employers with a health insurance plan; the other is for employers who don’t offer a health plan.
