    DOL releases two new labor law posters

    The U.S. Department of Labor (DOL) recently released updated posters summarizing employee rights under the Fair Labor Standards Act (FLSA) and Family and Medical Leave Act (FMLA).

    The FLSA minimum wage poster addresses employer obligations under the Providing Urgent Maternal Protections for Nursing Mothers (PUMP) Act, adopted in December 2022. Employers subject to the requirement must provide both exempt and non-exempt employees reasonable break time and a space (other than a bathroom) to express milk in the workplace. Prior to PUMP, the protections only applied to non-exempt employees.

    The FMLA poster simplified language defining when an eligible employee is entitled to FMLA leave. FMLA-qualifying events are

    • the birth, adoption or foster placement of a child,
    • an employee’s serious mental or physical health condition that renders the employee unable to work,
    • to care for a spouse, child or parent with a serious mental or physical health condition, and
    • certain qualifying reasons related to the foreign deployment of a spouse, child or parent who is a military servicemember.

    The poster also adds language defining a “covered employer,” as

    • a private employer that had at least 50 employees during at least 20 workweeks in the current or previous calendar year,
    • an elementary or public or private secondary school, or
    • a public agency, such as a local, state or federal government agency.

    Still to come this summer is an updated Equal Employment Opportunity Commission (EEOC) poster. Once available, Bukaty Companies will issue a communication.
