EEO-1 data collection period opens October 31

Private employers with 100 or more employees and federal contractors with 50 or more employees are required to file an annual report with the Equal Employment Opportunity Commission (EEOC) detailing workforce demographic data. The deadline for 2022 EEO-1 Component 1 data is December 5, 2023. Employers can begin submitting data October 31.

Employers must provide data on employee count by job category, sex, race, or ethnicity. Data can be manually entered in the EEO-1 Component 1 Online Filing System (OFS) or uploaded following EEOC filing specifications. Click here for the updated 2022 EEO-1 Component Instruction Booklet.

    Pay data collection suspended
In 2016 the EEOC adjusted the EEO-1 form to include a controversial collection of employee pay data, referred to as Component 2. After collecting 2017 and 2018 data, the EEOC voted in 2019 to discontinue EEO-1 Component 2 pay data collection. It’s unclear if the EEOC will reinstate the pay data collection requirement at some point in the future.
