    Revised EEO-1 pay-data requirement upheld

    Regulations requiring employers to collect and report wage information by race, gender and ethnicity were reinstated by a federal judge on March 4. The ruling will apply to all employers required to file an EEO-1 report, which includes all companies with over 100 employees as well as federal contractors with 50 or more employees. First-time filers must register with the Equal Employment Opportunity Commission (EEOC).

    Previously, employers were required to report demographic data such as race, gender and ethnicity, but not the pay data for each group. These additional requirements will allow the EEOC to clearly monitor payment practices and support federal anti-discrimination laws in the workplace, but it will also add more paperwork to employers’ desks.

    The EEOC and the Office of Management and Budget announced pay data (Component 2) for 2018 is due September 30, 2019. It is advised that employers begin collecting pay data accordingly. The traditional EEO-1 report (Component 1) is still due May 31, 2019, pushed from its original deadline of March 31 due to the government shutdown.

    “This new reporting requirement may be cumbersome for employers, but it’s important to stay updated on the legislation and comply accordingly to avoid potential EEOC violations and fines,” Mary Amundsen, managing director and compliance officer, said.
