The U.S. Supreme Court ruled June 27, 2025, that the zero-cost preventive care mandate within the Affordable Care Act (ACA) would remain in place. The Court was the final judicial stop in Kennedy v. Braidwood Management, Inc., challenging the constitutionality of the U.S. Preventive Services Task Force (PSTF), responsible for recommending many of the preventive services coverage requirements under the ACA.
Plaintiffs argued that the appointed PSTF panel members did not possess the needed presidential authority to make such decisions extended to “principal officers.” The Court disagreed stating these individuals are “inferior officers” whose appointment by the Secretary of Health and Human Services are valid and consistent with the Appointments Clause.
