    Overtime threshold updates expected

    The U.S. Department of Labor (DOL) is expected to release a Notice of Proposed Rulemaking in May to update the salary threshold for overtime eligibility. Currently, non-exempt employees earning a salary of less than $684 a week, or $35,568 annually, are entitled to overtime pay for hours worked in excess of 40 within a seven-day period. The pay rate for those excess hours must be no less than time and a half of the employee’s normal rate.

    While an exact salary threshold has not been proposed, the anticipated notice will come on the heels of Senator Sherrod Brown’s recent efforts to introduce the Restoring Overtime Pay Act of 2023. This act would expand the pool of employees eligible for overtime pay to those who make up to $45,000 annually if it is passed.
